Privacy Notice for the Whistleblowing System
Data protection is a matter of trust. With this privacy notice, we inform you how companies of the BKW Group (hereinafter "We" or "BKW") process personal data in connection with the operation, use, handling, and follow-up of reports submitted via the whistleblowing system.
The whistleblowing system is intended to securely and confidentially receive, review, process, document, and take appropriate follow-up measures regarding reports of actual or suspected violations of laws, internal rules, codes of conduct, compliance requirements, human rights or environmental obligations, and other misconduct. This privacy notice applies in particular to reports submitted via digital reporting channels, web forms, hotlines, email addresses, personal reports, or other whistleblowing channels provided by BKW. In this privacy notice, you will learn in particular which personal data is processed for which purposes, on what legal basis this is done, who has access to the personal data, how we protect confidentiality, whether personal data is disclosed abroad, how long we retain personal data, what rights data subjects have, and how you can contact us with questions about data protection. This privacy notice is not part of any contract, even if it is referred to in a contract, policy, code of conduct, internal directive, or on a website. We may amend this privacy notice at any time in accordance with section 16. To the extent applicable to the respective processing, the Swiss Data Protection Act (DPA), the EU General Data Protection Regulation (GDPR), national whistleblower or whistleblowing laws, employment law provisions, criminal and supervisory law requirements, and, where applicable, other applicable national data protection laws shall apply.
